Terms & Conditions
I agree and undertake to be bound by and comply with the terms and conditions of the Winaday website (“the Site”) for participation in any competitions hosted therein (“the Competitions”). I understand that if I fail to comply with these terms for any reason, my entry may be deemed ineligible, and I may be disqualified from the Competitions.
The Competition will run weekly, beginning each Monday at 6:00 am and closing on the following Sunday at 11:59 pm (CAT) (“the Competition Period”). To enter and be eligible, entrants must be residents of the Republic of South Africa and at least eighteen (18) years of age.
The promoter of the Competition is Winaday (22 Cumberland Road, Paarden Eiland) and the respective sponsor of each competition (“the Sponsors”). Any person who is an employee of Winaday, the Sponsors, their affiliated companies, and/or any other agent, promoter, or person connected with the Competition, as well as any member of their family, shall not be allowed to enter the Competition and will be ineligible to participate. Any such entries will be automatically disqualified.
Winaday and the Sponsor shall be entitled, at their sole discretion, to declare any entry ineligible for the Competition. In such cases, Winaday and the Sponsor are not obligated to notify the entrant of their disqualification nor provide a reason for the decision. If the Promoter suspects any unfair or automatic entry practices (such as the use of bots, custom code, or any other automated methods), the Promoter reserves the right to disqualify any or all entries suspected to be recorded through such means.
All decisions of Winaday and the Sponsor shall be final, and Winaday and the Sponsor shall not enter into any correspondence, dialogue, or discussions with any person regarding any aspect of the Competition.
All entries must be original and must not be abusive, defamatory, offensive, derogatory, degrading, or otherwise unacceptable due to the nature of the material submitted. Winaday and the Sponsor may, at their sole discretion, determine that any entry is ineligible due to its content and may disqualify a person from the Competition.
The Competition rules may be amended by Winaday and the Sponsor at any time during the Competition. Winaday and the Sponsor reserve the right to alter, amend, substitute, or cancel this Competition (including, but not limited to, prize value and/or prizes) in its entirety. In the event of an amendment, alteration, or cancellation, Winaday and the Sponsor will not compensate any individual for any reason whatsoever. Any notifications of this nature will be communicated on the Winaday website or social media pages.
The prize for each Competition will vary and may include a range of items or experiences. Detailed descriptions of the current prizes can be found in the competition section of the Winaday website. Specific terms regarding transportation and accommodation will also be outlined there for prizes that require travel. All prizes are subject to availability and may change at the discretion of Winaday and the Sponsor.
Entry to the competitions is open to all members of the public, with no entry cost. Any costs incurred while entering are your responsibility. To enter a competition, please follow these steps:
- Visit the competition page of the Winaday website.
- Review the available competitions and select the one you wish to enter.
- Follow the specific instructions provided for each competition to complete your entry.
- Make sure to enter each competition individually, as each may have different requirements and prize offerings.
- By participating in the Competition, you confirm your acceptance of these terms and conditions of entry. All entries must be completed within the Competition Period. Once an entry is made by the specified steps, participants may consider their entry valid.
Winaday and the Sponsor cannot accept responsibility for any incomplete entries, delayed beyond the Competition Period, failed to arrive, illegible, or for any other reason not received by the deadline. Additionally, Winaday and the Sponsor will not be liable for any costs or charges incurred regarding any entries.
Each person enters the Competition at their own risk and expense. By participating and submitting an entry, you acknowledge and agree that your entry may be shared by Winaday and the Sponsor on social media. The sharing of any content by Winaday and the Sponsor does not signify that a participant has won the Competition.
At the end of the Competition Period, Winaday will select the current number of winners at its discretion, and that decision will be final. The winners will be contacted by telephone or email, and their address details will be verified. Winners will be announced on the following Monday after the competition closes.
Winners that are selected from the automated platform and contacted by the vetting department have 7 days to reply. That reply must be made either by telephone call or email. Failing to reply or confirm within this period will result in the winner forfeiting the prize.
By submitting an entry to the Competition, you agree to grant Winaday and the Sponsor the right to use your name, likeness, and any biographical facts provided to the Promoter in connection with the fulfilment of the Prize. By entering this Competition, you acknowledge and agree that Winaday and the Sponsor shall own all rights and title to any materials created in connection with the Prize and shall have the right to distribute such materials (in whole or in part) worldwide, in perpetuity, via any and all media.
Entrants acknowledge and agree that they may be required to be used in publicity without further consent or payment if they are selected as the winner of the Prize. The Promoter and its affiliates will not be responsible for any harm, damage, loss, or claim relating to the provision of any element of a prize or any changes to a prize that may be made at any time. Prizes are not transferable and cannot be sold, deferred, or exchanged for cash. If the winner declines the Prize, cannot be contacted within 48 hours, or is disqualified for any other reason, Winaday shall select a new winner.
By entering this Competition, entrants agree to be bound by these terms and conditions, as well as the General Competition Rules and Privacy Policy, which can be found on the Winaday website.
By using a third-party social media platform (Twitter, Facebook, Instagram, YouTube, etc.) in the Competition entry process, you agree to abide by the terms and conditions of the third-party platform and should note that any use of profanity, vulgar language, sexist, political, defamatory, or racially motivated content or any other form of discrimination will be removed from the social media platform, resulting in automatic disqualification.
Where, for any reason beyond the reasonable control of Winaday, the Competition cannot be carried out and/or completed as planned and/or advertised, Winaday reserves the right to cancel the Competition at any time and shall not be liable to any person for any reason who may have entered the Competition.
These terms and conditions shall be governed by the laws of South Africa. By entering this Competition, you consent to the non-exclusive jurisdiction of the High Courts of South Africa (Gauteng Local Division, Johannesburg) in respect of all matters arising out of or in connection with the Competition or these terms and conditions.
If any provision of these terms and conditions is found to be invalid or unenforceable by any court of competent jurisdiction, that provision shall be severed from these terms and conditions and shall not affect the validity or enforceability of any remaining provisions.
It is not intended that any provision of these terms and conditions contravenes any provision of the Consumer Protection Act, 68 of 2008; therefore, all provisions of these rules must be treated as being qualified, if necessary, to ensure compliance with the provisions of the Consumer Protection Act.
All entrants hereby consent to Winaday processing their personal information for this Competition. The personal information submitted for the Competition will be securely held by Winaday. This information will only be shared with third parties involved with the Competition for the administration of the Competition and/or the supply and delivery of the Prize. The personal information of any entrant will only be held for 24 months (2 years) from the date of competition entry and will then be destroyed and/or deleted. Should an entrant wish to have their personal information amended or deleted, they should contact Winaday.
